California's new AV permit rules will reshape who can run robotaxis in 2027

Waymo and Zoox publicly welcomed the changes. The cynical reading is that the rules raise the bar for new entrants. The cynical reading is also probably correct, but it is not the only reading.

Incumbents also have an operational interest in a more rigorous regulatory environment because their own safety data tends to look favourable next to first-year deployment data from new entrants. Mature operating-domain disclosures are an advantage when the regulator is comparing apples to apples.

What this means for new entrants

A few companies are most affected.

Tesla's robotaxi plans, which depend on permissions in California specifically, get harder. The third-party audit requirement is a significant new cost and a slow process.

Several Chinese AV operators planning US expansion will face a higher bar for entry. The structured incident reporting requirement is meaningfully more demanding than what they currently produce for Chinese regulators.

Smaller US operators planning expansion outside their current geofenced markets face new disclosure costs that scale with each new operating domain.

What is likely next

Expect at least one of the smaller AV operators to publicly criticise the rules in the next quarter. Expect Tesla, in particular, to push back through state-level political channels. Expect Waymo to expand its California footprint relatively unencumbered.

The rules are reasonable on their face. They are also unmistakably tilted toward incumbents. Both can be true.
